Marqetir is an AI-powered marketplace listing engine that helps e-commerce sellers create, optimize, and manage product listings across multiple European marketplaces. The Service:

• Connects to your existing e-commerce stores (e.g., Shopify, WooCommerce) to import product data
• Uses artificial intelligence to generate and optimize marketplace-ready product listings
• Translates and localizes content for target marketplaces and languages
• Facilitates publishing listings to supported marketplaces (e.g., Amazon, Kaufland, Otto, bol.com)
• Provides tools for managing and monitoring your marketplace presence

To use the Service, you must:

• Be at least 18 years old or the age of legal majority in your jurisdiction
• Have the legal authority to enter into these Terms on behalf of yourself or the business entity you represent
• Have valid accounts on the e-commerce platforms and marketplaces you wish to connect
• Use the Service in compliance with all applicable laws and marketplace policies

When you create an account with Marqetir, you agree to:

• Provide accurate, current, and complete registration information
• Maintain and promptly update your account information
• Keep your login credentials secure and confidential
• Accept responsibility for all activity that occurs under your account
• Notify us immediately at if you suspect unauthorized access

You may not share your account credentials, create multiple accounts for the same business, or use another person's account without authorization.

4.1 Plans and Pricing

The Service is offered on a subscription basis. Current plans, features, and pricing are available on our website. We reserve the right to modify pricing with 30 days' advance notice to active subscribers.

4.2 Free Trial

We may offer a free trial period. At the end of the trial, your subscription will begin unless you cancel before the trial expires. No charges are made during the trial period.

4.3 Billing

Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. Payment is processed through our third-party payment provider. By subscribing, you authorize us to charge your selected payment method on a recurring basis.

4.4 Refunds

Subscription fees are generally non-refundable. However, if you are unsatisfied with the Service within the first 14 days of your initial paid subscription, you may request a refund by contacting . Refund requests are evaluated on a case-by-case basis.

4.5 Cancellation

You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of the current billing period. You will retain access to the Service until your paid period expires.

You agree not to use the Service to:

• Violate any applicable law, regulation, or marketplace terms of service
• List prohibited, counterfeit, illegal, or restricted products on any marketplace
• Infringe upon the intellectual property rights of others
• Submit false, misleading, or deceptive product information
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service
• Interfere with or disrupt the Service, servers, or networks
• Use automated systems (bots, scrapers) to access the Service beyond approved APIs
• Circumvent any usage limits, access controls, or security features
• Resell, sublicense, or redistribute the Service without our written permission

We reserve the right to suspend or terminate accounts that violate these terms without prior notice.

To provide the Service, you grant Marqetir access to certain data from your connected e-commerce stores and marketplace accounts, including but not limited to:

• Product catalogs (titles, descriptions, images, prices, inventory)
• Store configuration and settings
• Order and fulfillment data as needed for listing management
• Marketplace account credentials and API tokens

You represent that you have the right to share this data with us and authorize us to process it for the purposes of providing the Service. We handle your data in accordance with our Privacy Policy.

You retain full ownership of your product data and content. You may request data export or deletion at any time.

The Service interacts with third-party marketplace APIs on your behalf. By using the Service:

• You acknowledge that marketplace API access is subject to each marketplace's terms and policies
• You agree to comply with all applicable marketplace seller agreements and policies
• You understand that marketplaces may modify, restrict, or revoke API access at any time
• You accept that Marqetir is not responsible for actions taken by marketplaces regarding your seller account, listings, or content

We make reasonable efforts to maintain API integrations but cannot guarantee uninterrupted access to any third-party marketplace.

The Service uses artificial intelligence to generate and optimize product listings, including titles, descriptions, bullet points, and translated content. Regarding AI-generated content:

• You are responsible for reviewing all AI-generated content before publishing
• We do not guarantee the accuracy, completeness, or legal compliance of AI-generated content
• You retain ownership of content derived from your product data
• You are solely responsible for ensuring that published listings comply with marketplace requirements and applicable laws
• Marqetir may use anonymized and aggregated usage patterns to improve its AI models

All content, features, functionality, software, design, and documentation of the Service are the exclusive property of Marqetir or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or create derivative works based on the Service without our express written permission. Your use of the Service does not grant you ownership of any intellectual property in the Service.

You retain ownership of your product data, images, and content that you upload to the Service.

The Service integrates with and relies on third-party services, including but not limited to e-commerce platforms, marketplaces, payment processors, AI providers, and cloud infrastructure. Your use of these third-party services is subject to their respective terms and conditions.

We are not responsible for the availability, accuracy, or actions of any third-party service. Changes made by third-party providers may affect the functionality of the Service.

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that:

• The Service will be uninterrupted, timely, secure, or error-free
• AI-generated content will be accurate, complete, or suitable for your purposes
• Listings published through the Service will be approved by marketplaces
• Your sales or business performance will improve as a result of using the Service
• Third-party integrations will remain available or function as expected

To the maximum extent permitted by applicable law, Marqetir, its directors, employees, partners, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, revenue, data, business opportunities, or goodwill, arising from or related to your use of or inability to use the Service.

Our total aggregate liability under these Terms shall not exceed the total amount you have paid to Marqetir in the twelve (12) months immediately preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits our liability for matters that cannot be excluded or limited under applicable law, including liability for fraud or willful misconduct.

You agree to indemnify, defend, and hold harmless Marqetir and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights, including marketplace terms
• Content you publish through the Service
• Your products or business practices

We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent or abusive behavior, or for any other reason at our sole discretion.

You may terminate your account at any time by canceling your subscription and discontinuing use of the Service. Upon termination:

• Your right to access the Service ceases immediately
• We may delete your data after a reasonable retention period (typically 30 days)
• You may request export of your data before account deletion
• Outstanding fees remain due and payable
• Provisions that by nature should survive termination will survive (including liability, indemnification, and intellectual property sections)

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you via email or through the Service at least 30 days before the changes take effect.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of the changes. If you do not agree with the revised Terms, you must stop using the Service and cancel your subscription.

These Terms shall be governed by and construed in accordance with the laws of the European Union and the applicable national law of the jurisdiction in which Marqetir is established, without regard to conflict of law principles.

Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the competent courts in the jurisdiction where Marqetir is established. Nothing in these Terms affects your rights as a consumer under applicable mandatory consumer protection laws.
