Understanding German VAT (Mehrwertsteuer) for E-Commerce Sellers

Germany is the largest e-commerce market in Europe, generating over EUR 90 billion in online retail sales annually. The German VAT system, known as Mehrwertsteuer (MwSt) or Umsatzsteuer (USt), is administered by the Bundeszentralamt fur Steuern (BZSt) at the federal level, with individual Finanzamter (tax offices) handling day-to-day compliance. For any seller serious about European e-commerce, understanding German VAT is non-negotiable.

German VAT Rates Explained

Germany operates a two-rate VAT system for most practical purposes:

  • 19% Standard Rate: The default rate for the vast majority of goods and services. This covers consumer electronics, clothing, software, cosmetics, household items, and most products sold on German marketplaces. If you are unsure which rate applies, 19% is almost always the correct choice for general merchandise.
  • 7% Reduced Rate: Applies to food and non-alcoholic beverages (for takeaway or retail, not restaurant consumption), books and e-books, newspapers and periodicals, public transportation, hotel accommodation (room charges only), cut flowers and plants, admission to cultural events, and works of art sold by their creators. The distinction between 7% and 19% for food is notoriously complex in Germany -- restaurant meals are 19%, takeaway is 7%, and mixed scenarios require splitting.
  • 0% Exempt: Intra-EU B2B supplies with valid VAT ID verification, exports to countries outside the EU, and certain financial and insurance services are VAT-exempt.

OSS and Cross-Border Selling to Germany

The EU One-Stop-Shop (OSS) scheme allows sellers based in other EU countries to declare German VAT without registering locally, provided they are registered for OSS in their home country. The EU-wide threshold is EUR 10,000 per calendar year for total cross-border B2C sales. Above this threshold, you must charge the German 19% rate (or 7% for qualifying products) to German consumers.

Germany is the most common FBA destination in Europe. If you use Amazon FBA and your inventory is stored in German warehouses (such as those in Bad Hersfeld, Graben, Werne, or Rheinberg), you must register for German VAT regardless of your sales volume. This also applies if you ship goods from Germany to other EU countries through Pan-European FBA. Amazon requires a valid German VAT ID (USt-IdNr.) before activating your FBA account for German fulfillment.

VAT Registration Process in Germany

To register for German VAT, you submit an application to the competent Finanzamt. For foreign businesses without a German establishment, the designated office depends on your home country. The application is submitted via the ELSTER electronic filing system or through a German tax advisor. Key documents include proof of business registration, a copy of your EU VAT certificate, and information about your German business activities.

Processing time is typically 4-8 weeks, though it can take longer during peak periods. Germany issues two numbers: a Steuernummer (tax number) for filing returns and a USt-IdNr. (VAT identification number, format DE123456789) for intra-EU transactions. Most marketplace platforms require the USt-IdNr.

Marketplace-Specific Considerations

Germany hosts several major e-commerce marketplaces. Amazon.de is the largest with over 500 million monthly visits and acts as a deemed supplier for third-party sellers in many scenarios, handling VAT collection on your behalf. eBay.de, Kaufland.de (formerly real.de), Otto.de, and Zalando are other major platforms where German VAT compliance is mandatory. Since 2019, German marketplace liability rules (Section 22f UStG) require platforms to verify sellers' VAT registration and hold sellers liable for non-compliance.

German consumers expect prices inclusive of VAT (Bruttopreise), and this is legally required for B2C pricing displays under the Preisangabenverordnung (PAngV). All your listed prices on German marketplaces must include the applicable MwSt rate.
