Understanding Polish VAT for E-Commerce Sellers

Poland operates a value-added tax system known as podatek od towarow i uslug (PTU), commonly referred to simply as VAT. The Polish tax authority, Krajowa Administracja Skarbowa (KAS), administers VAT collection and enforcement. For e-commerce sellers targeting the Polish market through platforms like Allegro, Amazon.pl, Kaufland.pl, or their own Shopify stores, understanding the Polish VAT structure is essential to maintaining compliance and competitive pricing.

Polish VAT Rates Explained

Poland has four VAT rates, each applying to different categories of goods and services:

  • 23% Standard Rate: Applies to the majority of goods and services. This includes consumer electronics, clothing, furniture, home appliances, cosmetics, and most products sold on marketplace platforms. If your product does not fall into a specific reduced-rate category, the 23% rate applies by default.
  • 8% Reduced Rate: Covers food products that are not considered basic necessities, books (including e-books since 2020), newspapers and periodicals, hotel and accommodation services, restaurant and catering services (excluding alcohol), and certain construction works related to residential housing.
  • 5% Super-Reduced Rate: Reserved for basic foodstuffs such as bread, dairy products, fresh meat, fruits, and vegetables. Also applies to printed books, specialized periodicals, and sheet music. E-commerce sellers in the food and grocery sector frequently work with this rate.
  • 0% Zero Rate: Applies to intra-EU supplies of goods to VAT-registered businesses in other EU member states, exports outside the EU, and certain international transport services. This is not an exemption -- it means VAT is charged at 0%, but the seller retains input VAT deduction rights.

OSS Thresholds and Cross-Border Selling to Poland

Since July 2021, the EU One-Stop-Shop (OSS) scheme replaced the previous country-specific distance selling thresholds. The current EU-wide threshold is EUR 10,000 per calendar year for total cross-border B2C sales to all EU member states combined. This translates to approximately PLN 43,000 at current exchange rates.

If you are based in another EU country and your total cross-border B2C sales exceed EUR 10,000, you must charge the destination country VAT rate (23% for standard-rated goods in Poland). You can handle this through the OSS portal in your home country, which eliminates the need to register for VAT in Poland separately.

However, if you store goods in Poland -- for example, using Amazon's FBA fulfillment centers in Wroclaw or Poznan -- you must register for Polish VAT regardless of your sales volume, as the goods are being supplied from Polish territory.

VAT Registration Requirements in Poland

Foreign businesses that need to register for Polish VAT must submit the VAT-R form to the Second Tax Office in Warsaw (Drugi Urzad Skarbowy Warszawa-Srodmiescie), which handles all foreign entity registrations. EU-based businesses can register directly without appointing a fiscal representative. Non-EU businesses must appoint a Polish fiscal representative before registration.

Once registered, you will receive a Polish NIP (Numer Identyfikacji Podatkowej) and must comply with Polish invoicing requirements, including the mandatory JPK_V7 electronic reporting format. Poland was one of the first EU countries to mandate real-time electronic reporting, and compliance with the JPK (Jednolity Plik Kontrolny) Standard Audit File system is strictly enforced.

Key Considerations for Marketplace Sellers

Allegro is the dominant marketplace in Poland, with over 135,000 active sellers and 22 million monthly users. When selling on Allegro as a foreign seller, you should be aware that Allegro does not act as a deemed supplier for VAT purposes in most cases -- meaning you, the seller, remain responsible for VAT compliance. Amazon.pl, on the other hand, may handle VAT as a deemed supplier for certain third-party sellers under the EU marketplace facilitator rules.

Polish consumers increasingly expect prices displayed inclusive of VAT (gross prices), which is standard practice across all major Polish marketplaces. Make sure your pricing strategy accounts for the applicable VAT rate to maintain healthy margins.
